1. Acceptance of Terms

These Terms and Conditions ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "Player", "You") and one365 ("one365", "Company", "We", "Us", "Our"), a PAGCOR-licensed online casino and sports betting operator registered and operating under the laws of the Republic of the Philippines. The following persons are strictly prohibited from using one365 Services: (a) individuals under the age of 21; (b) employees, officers, directors, contractors, or agents of one365 or any affiliated company; (c) immediate family members of persons described in subsection (b); (d) individuals who have previously been excluded from one365 or any gambling establishment for problem gambling or fraudulent activity; (e) individuals currently enrolled in self-exclusion programs; (f) individuals located in jurisdictions where online gambling is prohibited or restricted by law.

3. Account Registration and Security

3.1 Account Creation

To access certain features of the one365 Services, including real-money gambling, you must register an account by providing accurate, current, and complete information as prompted by the registration form. Required information includes, but is not limited to: full legal name, date of birth, email address, mobile telephone number, residential address, and government-issued identification details. Each individual is permitted to register and maintain only one (1) account with one365. Creating multiple accounts ("multi-accounting") is strictly prohibited and will result in immediate suspension of all accounts and forfeiture of all balances and winnings. Accounts are personal, non-transferable, and may not be shared, sold, transferred, or assigned to any third party under any circumstances. You are solely responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree to immediately notify one365 of any unauthorized access to or use of your account.

3.3 Identity Verification (KYC)

As part of our regulatory obligations under PAGCOR licensing requirements and to prevent fraud, money laundering, and underage gambling, one365 implements mandatory Know Your Customer (KYC) procedures. You agree to provide, upon request, copies of government-issued identification documents (passport, driver's license, or national ID), proof of address (utility bills or bank statements), and any additional documentation reasonably requested to verify your identity, age, and address. We reserve the right to suspend account functionality, including withdrawals, until satisfactory verification is completed. Failure to provide requested documentation within fourteen (14) days of request may result in account suspension or termination.

4. Deposits and Withdrawals

4.1 Deposits

All deposits are subject to minimum and maximum limits as specified for each payment method. Deposited funds must originate from a legitimate source legally owned and controlled by you. We strictly prohibit deposits from third-party payment sources, stolen credit or debit cards, or funds obtained through illegal means. Any suspected fraudulent deposits will be reported to appropriate law enforcement authorities.

4.2 Withdrawals

5.2 Bonus Abuse

Prohibited activities include, but are not limited to: creating multiple accounts to claim bonuses multiple times, coordinated betting patterns designed to meet wagering requirements with minimal risk, use of software or automated systems to manipulate bonus outcomes, and collusion with other players. Detected bonus abuse will result in immediate forfeiture of all bonuses and winnings, account termination, and potential legal action.

6. Gameplay Rules and Conduct

6.1 Fair Play

All gameplay on the one365 platform must be conducted in good faith and in accordance with the rules of each specific game as published on the Website. You agree not to engage in any fraudulent, collusive, or unfair gaming practices, including but not limited to: use of software bots or automated betting systems, exploitation of software errors or game glitches, collusion with other players to gain unfair advantage, card counting or other advantage play techniques prohibited by specific game rules, or any other conduct that undermines the integrity of the gaming experience.

6.2 Prohibited Conduct

You agree not to: (a) use the Services for any illegal purpose or in violation of any applicable law; (b) upload, transmit, or distribute viruses, malware, or any other harmful code; (c) attempt to gain unauthorized access to any portion of the Services or other user accounts; (d) engage in any conduct that harasses, threatens, or abuses other users or one365 staff; (e) reverse engineer, decompile, or disassemble any software used in connection with the Services; (f) use the Services while located in a jurisdiction where online gambling is prohibited; (g) engage in money laundering or other financial crimes using the Services.

7. Intellectual Property Rights

All content, materials, software, graphics, logos, trademarks, service marks, and other intellectual property displayed on or available through the one365 Website and Services are the exclusive property of one365, its licensors, or third-party content providers and are protected by Philippine and international copyright, trademark, and other intellectual property laws. The one365 name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of one365 or its affiliates. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial entertainment purposes only. Any unauthorized use, reproduction, distribution, or modification of our intellectual property is strictly prohibited and may result in civil and criminal liability.

8. Account Suspension and Termination

8.1 Suspension by one365

one365 reserves the right to suspend or terminate your account immediately, without prior notice, for any reason including but not limited to: (a) breach of any provision of these Terms; (b) suspected fraudulent, illegal, or abusive activity; (c) failure to provide requested identity verification documents; (d) use of the Services from a prohibited jurisdiction; (e) creation of multiple accounts; (f) suspected money laundering or financial crime; (g) failure to meet legal age requirements; (h) self-exclusion enrollment or problem gambling concerns; (i) prolonged account inactivity; (j) upon request by PAGCOR or other regulatory authorities.

8.2 Effects of Termination

Upon termination for cause, any remaining account balance, pending bonuses, and accumulated winnings may be forfeited at the sole discretion of one365. In cases of termination without cause or at your request (subject to any applicable withdrawal processing requirements), your account balance will be returned to you following completion of all pending transactions and deduction of any outstanding fees or liabilities. Termination does not release you from any obligations incurred prior to termination, including outstanding debts or liabilities to one365.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ONE365, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS (COLLECTIVELY, "ONE365 PARTIES") SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (C) ANY CONTENT OBTAINED FROM THE SERVICES; (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; (E) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICES; (F) GAMBLING LOSSES INCURRED THROUGH USE OF THE SERVICES; OR (G) ANY OTHER MATTER RELATING TO THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

ONE365 PARTIES' TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO ONE365 IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED US DOLLARS (USD $100), WHICHEVER IS GREATER.

10. Dispute Resolution and Governing Law

10.1 Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of the Republic of the Philippines. The Philippine Amusement and Gaming Corporation (PAGCOR) regulatory framework shall apply to all gaming-related disputes.

10.2 Dispute Resolution Process

In the event of any dispute, claim, or controversy arising from or relating to these Terms or the Services, you agree to first contact one365 customer support in good faith to attempt informal resolution. If the dispute cannot be resolved informally within thirty (30) days, the dispute shall be submitted to binding arbitration in accordance with the rules of the Philippine Dispute Resolution Center, Inc. The arbitration shall take place in Metro Manila, Philippines, and shall be conducted in English. The arbitrator's decision shall be final and binding.

10.3 Class Action Waiver

You agree that any dispute resolution proceedings, whether in arbitration or court, will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against one365.

11. Additional Provisions

11.1 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its intent, or if modification is not possible, such provision shall be severed from these Terms. The validity, legality, and enforceability of the remaining provisions shall not be affected or impaired.

11.2 Entire Agreement

These Terms, together with the Privacy Policy, Responsible Gaming Policy, and any other policies referenced herein, constitute the entire agreement between you and one365 regarding the use of the Services and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services.
